EB-1A: Individuals with Extraordinary Ability in their Field
EB-1A (Extraordinary Ability)
Purpose:
This is for foreign nationals who have demonstrated extraordinary ability as evidenced by sustained national or international acclaim in fields such as business, science, education, arts, or athletics.
How:
Employer sponsored or self-sponsored and reserved for foreign nationals who have sustained international acclaim and recognized for their extraordinary ability in their specific field.
Documentation requirements:
One-time achievement of a major internationally-recognized award, think Nobel Prize or extensive documentary evidence of extraordinary ability, which must include at least 3 of the following:
- Receipt of lesser nationally or internationally recognized prizes or awards.
- Memberships in exclusive organizations requiring outstanding achievement of their members.
- Major media coverage about you in professional or trade publications in the field.
- Evidence of high salary or other significant recognition.
- Original work documented by patents, licences, commercialization of research innovation, contributions to open-source repositories or other technical resources, and reference letters from government entities and other experts in the field, i.e. original contributions of major significance.
- Scholarly peer-reviewed articles in the field.
- Service as the judge of the work of other professionals in the field.
- Performing in a leading or critical role at distinguished organizations.
- Documentation of work being displayed at artistic exhibits or showcases.
- Commercial successes in the performing arts (e.g., box office, sales)
- Final merits determination based on the totality of the evidence, which is also an opportunity to include additional evidence not mentioned above.
